Dagegen argumentiert Kim Henningsen: Auch das Individuum müsse als Völkerrechtssubjekt im globalen Raum gesehen und gehört werden, es dürfe nicht länger als ausschließlich passiver Rechtsrezipient und Schutzbefohlener verstanden werden. Zur Begründung der These wird die Normativität historischer Entwicklungen mithilfe Hannah Arendts neu durchdacht und zur Legitimationsfigur der Realisierung individueller Völkerrechtssubjektivität verdichtet. Diese wird schließlich auf das Rechtsfeld maritime Migration angewandt, um die normative Rechtfertigung der aktuellen Völkerrechtspraxis zu ergründen.Summary: Klappentext engl.: What makes international law legitimate? Based on a critique of the traditional idea of state voluntarism and canonical notions of legitimacy, this book develops an alternative conception of international legal legitimacy. Hannah Arendt's political thinking guides its normative analysis of historical developments, especially the so-called humanisation of international law, and helps to justify the claim that international law can be considered legitimate insofar as individuals can realise their own international legal subjectivity.
