Es fragt sich, ob das Urheberrecht gleichwohl vor Verwechslungsgefahr schützt. Bei entsprechenden Parallelen könnten nicht nur urheberrechtliche Begriffe schärfer konturiert werden, sondern auch die Grundsätze zur Beurteilung der Verwechslungsgefahr im Marken- und Wettbewerbsrecht überdacht werden.Summary: In contrast to the Spanish Copyright Law and the relevant case-law of French courts relating to copyright infringements, the term ‘likelihood of confusion’ is not used in German Copyright Law but in Trade Mark Law and the Law Against Unfair Competition. Therefore, the question may be raised whether the German Copyright Law nevertheless provides protection from the risk of confusion.
