This work deals with the interplay between cartelization and Constitutional law and focusses on the new regulation under § 30 para. 2a incorporated by the 8th amendment to the GWB to which the price fixation contracts between the publisher and wholesaler and the wholesaler and the retailer is subject to.This work, in addition to the historical classification of the Presse-Grosso system, its present functioning and the requirement of press wholesalers to contract within existing legal frameworks also focuses on the violation of a central negotiating mandate against the ban on cartelization and the possible exemption options.Summary: Dem Presse-Grosso kommt im Rahmen des deutschen Pressevertriebssystems eine besondere Rolle zu. Die Sicherstellung einer flächendeckenden Versorgung mit Zeitungen und Zeitschriften dient der Presse-, Meinungs- und Informationsfreiheit. Die Arbeit geht den durch die Rechtsprechung aufgeworfenen Fragestellungen des Kartell- und Verfassungsrechts nach. Im Fokus der Betrachtung steht dabei die im Rahmen der 8. GWB-Novelle geschaffene Neuregelung des § 30 Abs. 2a GWB. Neben der historischen Einordnung des Presse-Grosso-Systems, dessen gegenwärtiger Funktion und der Frage eines Kontrahierungszwangs im Rahmen bestehender Rechtsverhältnisse, konzentriert sich die Prüfung auf einen Verstoß des zentralen Verhandlungsmandates gegen das Kartellverbot und mögliche Freistellungsoptionen.
